2) the structural divisions of the territorial bodies of the Ministry of the Russian Federation on Civil Defense, Emergency Situations and Elimination of Emergency Disasters - Regional Civil Defense Centers, Emergency Situations and Elimination of Disaster Consequences, which include the organization and implementation of the State Fire Supervision;

3) Structural units of the territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Elimination of Disaster Concepts - bodies, specially authorized to solve the tasks of civil defense and the task of preventing and eliminating emergency situations on the constituent entities of the Russian Federation, whose scope of management includes organizations and the implementation of the state fire supervision, and their territorial departments (branches, inspections);

4) Departments (branches, inspections, groups) of the state fire supervision of the units of the Federal Fire Service, created in order to organize the prevention and extinguishing of fires in closed administrative-territorial entities.

4. The activities of state fire supervision bodies are carried out on the basis of subordination of the lower state fire supervision authorities to the higher.

5. The bodies of the State Fire Supervision are guided in their activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the International Treaties of the Russian Federation, the regulatory legal acts of the Ministry of the Russian Federation for Civil Defense, Emergencies and Liquidation The effects of natural disasters, as well as this provision.

6. State Fire Supervision Bodies as part of their competence:

1) organize and supervise compliance with fire safety requirements by federal executive bodies, the executive authorities of the constituent entities of the Russian Federation, local governments, organizations, as well as officials and citizens;

2) are carried out in accordance with the legislation of the Russian Federation inquiry on fire affairs and cases of violations of fire safety requirements;

5) define officials of the state fire supervision bodies for conducting oversight activities;

7) Consider the appeals and complaints of citizens and organizations on fire safety issues.

8. Exercise on behalf of the state fire supervision bodies have the right to the following state inspectors for fire supervision:

3) State Inspectors of the Russian Federation for Fire Supervision - Employees of the Structural Unit of the Central Office of the Ministry of the Russian Federation on Civil Defense Affairs, Emergency and Elimination of Disaster Consequences, which include the organization and implementation of state fire supervision, staff of structural divisions of the territorial bodies of the Ministry Of the Russian Federation for civil defense, emergency situations and elimination of the effects of natural disasters - regional centers for civil defense, emergency situations and elimination of natural disasters, whose scope includes issues of organization and implementation of state fire supervision;

4) the main state inspectors of the constituent entities of the Russian Federation for the Fire Supervision and their deputies - respectively, the heads of the structural divisions of the territorial bodies of the Ministry of the Russian Federation on Civil Defense, Emergencies and the Elimination of the Impact of Emergency Disasters - organs specifically authorized to solve the tasks of civil defense and the warning tasks and Emergency response to the subjects of the Russian Federation, whose scope of management includes issues of organization and implementation of state fire supervision, and their deputies;

5) State inspectors of the constituent entities of the Fire Supervision - employees of the structural divisions of the territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of Disaster Consequences - bodies, specially authorized to solve the tasks of civil defense and the task of preventing and eliminating emergency situations on subjects Of the Russian Federation, whose scope includes issues of organization and implementation of state fire supervision;

6) The main state inspectors of the closed administrative-territorial formations for fire supervision and their deputies are, respectively, the heads of departments (offices, inspections, groups) of the State Fire Supervision of the Federal Fire Services Divisions created in order to organize the prevention and extinguishing of fires in closed administrative-territorial entities, and their deputies;

9. State inspectors of cities (districts) of the constituent entities of the Russian Federation for Fire Supervision and state inspectors of closed administrative-territorial formations for fire supervision are entitled:

1) exercise public fire supervision in compliance with fire safety requirements by organizations, as well as officials and citizens;

2) conduct examinations and inspections of territories, buildings, structures, facilities of organizations and other objects, including inoperative time, in order to control compliance with the requirements of fire safety and suppress their violations;

3) require submission of documents, information, samples (samples) of products, if they refer to the subject of verification;

4) to enter into unhindered in the manner prescribed by the legislation of the Russian Federation, in residential and other premises, on the land plots of citizens in the presence of reliable data on violation of fire safety requirements, creating a threat to the emergence of a fire and (or) a threat to people's safety;

5) to give managers of legal entities and individual entrepreneurs, officials and citizens compulsory to fulfill the prescription to eliminate violations of fire safety requirements;

6) excluded.

7) to terminate briefly before the case consideration by the court, in the manner prescribed by the legislation of the Russian Federation on administrative offenses, the activities of branches, representative offices, structural units of the legal entity, production sites, as well as the operation of aggregates, objects, buildings or structures, the implementation of certain types of activities ( works), provision of services, if necessary, to prevent the immediate threat of fire and (or) threats to the life or health of people, and if the prevention of these circumstances is impossible in other ways;

10) to draw up protocols, consider cases on administrative offenses and appoint administrative penalties in accordance with the legislation of the Russian Federation for violations of fire safety requirements.

10. The main state inspectors of the cities (districts) of the constituent entities of the Russian Federation for Fire Supervision and their deputies, as well as the main state inspectors of closed administrative-territorial formations for fire supervision and their deputies enjoy the rights listed in this Regulation, and also have the right to:

1) exercise public fire supervision in compliance with the requirements of fire safety by the territorial bodies of federal executive bodies and local governments;

2) to give managers of legal entities and individual entrepreneurs, officials and citizens compulsory to fulfill the prescription to ensure fire safety in relation to goods (works, services), withdrawal, discontinuation of the issue and suspension of the sale of goods (works, services) that do not meet the requirements fire safety;

11. State inspectors of the constituent entities of the Fire Supervision of the Fire Supervision are enforceable, and also have the right to consider in the prescribed manner in terms of compliance with the Fire Safety Requirements Urban Planning and Design and Establish Documentation for Construction, Overhaul, Reconstruction, Expansion and Technical Redevelopment of organizations, buildings, structures and other objects with reasonable deviations from the current requirements or in the absence of these requirements.

12. The main state inspectors of the constituent entities of the Russian Federation for Fire Supervision and their deputies enjoy the rights specified in - 11 of these Regulations, and also have the right:

1) exercise public fire supervision in compliance with fire safety requirements by the executive authorities of the constituent entities of the Russian Federation;

2) to contribute to the state authorities of the constituent entities of the Russian Federation proposals for the implementation of fire safety measures in accordance with the legislation of the Russian Federation;

3) Subject to the authorities of the subjects of the Russian Federation proposals for the establishment of a special fire-fighting regime in the territories of the constituent entities of the Russian Federation.

13. State inspectors of the Russian Federation for Fire Supervision enjoy the rights specified in the 12th Regulations, and also have the right to implement public fire supervision for compliance with fire safety requirements by federal executive authorities.

14. The Chief State Inspector of the Russian Federation for Fire Supervision and his deputies are endowed with the rights established by the legislation of the Russian Federation, in full.

15. Officials of the state fire supervision bodies are given relevant service certificates and officials. Samples of service certificates and officials, as well as the procedure for issuing their issuance are determined by the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Eliminate Disaster Consequences.

16. Officials of state fire supervision bodies are required:

1) in a timely manner and fully fulfill the powers provided in accordance with the legislation of the Russian Federation to prevent, identify and curb violations of fire safety requirements;

2) comply with the legislation of the Russian Federation, the rights and legitimate interests of organizations and citizens;

3) conduct measures to control on the basis and in strict accordance with the regulations of the state fire supervision authorities on conducting measures to control in the manner prescribed by the legislation of the Russian Federation;

4) attend objects (territories and premises) of organizations in order to conduct control measures only during official duties upon presentation of official certificates and orders of state fire supervision authorities on conducting measures to control;

5) not to impede representatives of organizations to attend when conducting measures to control, give explanations on issues related to subjects of their inspections;

6) to provide legal entities and individual entrepreneurs or their representatives present in conducting measures to control the necessary information;

7) to acquaint managers of legal entities and individual entrepreneurs or their representatives with the results of measures to control;

8) in determining measures taken by the facts of violations identified, take into account the compliance of these gravity measures of violations, their potential hazards for the life and health of people, the environment and property, as well as prevent unjustified restriction of the rights and legitimate interests of citizens and organizations;

9) to prove the legality of their actions when they appeal in the manner prescribed by the legislation of the Russian Federation;

10) to conduct within measures to control explanatory work on the application of the legislation of the Russian Federation on fire safety;

11) Comply with the commercial and other law protected by law.

17. Officials of state fire supervision bodies for improper performance of their duties are responsible in the manner prescribed by the legislation of the Russian Federation.

18. Citizens of the Russian Federation, which have a higher or secondary special education, which are held in the Ministry of the Russian Federation for Civil Defense, Emergencies and Emergency Disasters, certified for compliance with the qualification requirements, may be entitled to the rights and obligations of state inspectors for fire supervision. The scientific and technical support of the activities of the state fire supervision bodies is carried out by subordinate to the Ministry of the Russian Federation on civil defense, emergency situations and elimination of the effects of natural disasters by fire and technical research and educational institutions created in the prescribed manner.
